Terms of Use

Welcome to San Jose CAN (“San Jose CAN,” “we,” “our,” or “us”). San Jose CAN is a fully volunteer-organized civic action network founded and located in San Jose, California, Santa Clara County. San Jose CAN operates as a local chapter affiliated with the nationwide Indivisible movement, while maintaining its own local operations unless otherwise stated.


These Terms of Use (“Terms”) govern your access to and use of our website, communications, events, programs, and services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you should not use the Services.


1. Purpose of Organization

San Jose CAN is a volunteer-led civic engagement organization focused on community education, advocacy, and peaceful public action related to democratic participation, civil rights, and public policy issues. Participation in our Services is voluntary.


Nothing in these Terms creates a membership, partnership, employment, or agency relationship unless explicitly stated in writing.


2. Eligibility

You must be at least 13 years of age to use our Services. Individuals under 18 years of age should participate only with parental or guardian consent where appropriate.


By using our Services, you represent that you have the legal capacity to agree to these Terms.


3. User Conduct

You agree to use the Services only for lawful and respectful purposes. You agree not to:

  • Violate any applicable laws or regulations
  • Engage in harassment, threats, intimidation, or discrimination
  • Impersonate any person or organization
  • Disrupt meetings, events, or communications
  • Upload or transmit malicious software or harmful content
  • Attempt unauthorized access to systems or data
  • Use the Services for commercial solicitation without permission

We reserve the right to remove participants or restrict access for conduct that violates these Terms or disrupts organizational activities.


4. Volunteer Participation

San Jose CAN is operated exclusively by volunteers. Participation in volunteer activities is voluntary and does not create employment, compensation, benefits, or contractual rights unless explicitly agreed in writing.


Volunteers are responsible for their own actions and agree to follow applicable laws and safety guidance during activities.


5. Events, Meetings, and Public Activities

Participation in meetings, rallies, demonstrations, or other events involves personal choice and inherent risks. By participating, you acknowledge and accept responsibility for your own safety, conduct, and decisions.


San Jose CAN does not control all environments where events occur and cannot guarantee safety or outcomes. Participants agree to comply with lawful instructions from event organizers and applicable authorities.


6. Intellectual Property

All content provided through the Services, including text, graphics, logos, images, documents, and materials, is owned by San Jose CAN or used with permission unless otherwise indicated.


You may use materials for personal, noncommercial, and educational purposes. You may not reproduce, distribute, modify, or create derivative works without prior written permission, except as allowed by law.


7. User Submissions

If you submit content, comments, photos, or materials to San Jose CAN, you grant us a nonexclusive, royalty-free, worldwide license to use, reproduce, display, and distribute that content for organizational purposes, unless otherwise agreed.


You represent that you have the rights necessary to share submitted materials.


8. Privacy

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the collection and use of information as described in that policy.


9. Third-Party Services and Links

Our Services may include links to third-party websites, tools, or platforms. San Jose CAN does not control and is not responsible for third-party content, policies, or practices. Use of third-party services is at your own risk.


10. No Professional Advice

Information provided by San Jose CAN is for educational and informational purposes only. It does not constitute legal, financial, medical, or professional advice. You should consult qualified professionals for specific guidance.


11. Disclaimers

The Services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, San Jose CAN disclaims all warranties, express or implied, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, and non-infringement.


We do not guarantee uninterrupted access, error-free operation, or specific outcomes from participation.


12. Limitation of Liability

To the fullest extent permitted by law, San Jose CAN, its volunteers, organizers, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to:

  • Use of or inability to use the Services
  • Participation in events or activities
  • Reliance on information provided
  • Unauthorized access to data
  • Actions of third parties

If liability is found, it shall be limited to the maximum extent permitted under applicable law.


13. Indemnification

You agree to indemnify and hold harmless San Jose CAN, its volunteers, organizers, and affiliates from any claims, damages, losses, liabilities, costs, or expenses arising from:

  • Your violation of these Terms
  • Your conduct or participation in activities
  • Your violation of any law or third-party rights

14. Affiliation Disclosure

San Jose CAN operates as a local chapter affiliated with the nationwide Indivisible movement. Unless explicitly stated, San Jose CAN operates independently regarding local activities, communications, and decisions.


Participation in San Jose CAN does not automatically create participation in any national organization.


15. Modifications to Services

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without notice.


16. Termination of Access

We may restrict or terminate access to Services at our discretion for conduct that violates these Terms or is harmful to the organization or participants.


17. Governing Law

These Terms shall be governed by and interpreted under the laws of the State of California, without regard to conflict of law principles.


Any disputes arising from these Terms shall be resolved in the appropriate courts located in Santa Clara County, California, unless otherwise required by law.


18. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.


19. Changes to Terms

We may update these Terms periodically. Updated versions will be posted with a revised effective date. Continued use of the Services constitutes acceptance of any revisions.
